AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

As proposed, S.B. 919 creates The Lakes Municipal Utility and Management District of Tarrant County (district) as a political subdivision of this state to administer and provide funding for community improvement projects and services in the district. The district will be a municipal management district similar to those operating pursuant to Chapter 375 (Municipal Management District in General), Local Government Code, and Title 4, Special District Local Laws Code.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subtitle C, Title 4, Special District Local Laws Code, by adding Chapter 3855, as follows:

 

CHAPTER 3855. THE LAKES MUNICIPAL UTILITY AND MANAGEMENT DISTRICT

OF TARRANT COUNTY

 

Sets forth standard language for the creation of The Lakes Municipal Utility and Management District (district) of Tarrant County. Sets forth standards, procedures, requirements, and criteria for:

 

Creation and approval of the district (Sections 3855.001-3855.050);

 

Powers and duties of the district (Sections 3855.051-3855.100);

 

Size, composition, election, and terms of the board of directors of the district (Sections 3855.101-3855.150);

 

General financial provisions and authority to imposes taxes and issue bonds and obligations for the district (Sections 3855.151-3855.200);

 

Division of the district into multiple districts (Section 3855.201-3855.250); and

 

Dissolution of districts (Section 3855.251).

 

Authorizes the use of eminent domain by the district.

 

SECTION 2. Sets forth the initial boundaries of the district.

 

SECTION 3. Sets forth the initial board of directors for the district.

 

SECTION 4. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 5. Effective date: upon passage or September 1, 2007.
