AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, barbers and cosmetologists are required to practice at a fixed facility.  C.S.S.B. 984 allows for the operation of barbershops and cosmetology facilities at mobile locations. 

 

RULEMAKING AUTHORITY

 

Rulemaking authority is expressly granted to the Texas Commission of Licensing and Regulation in SECTION 1 (Section 1603.206, Occupations Code) of this bill.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subchapter E, Chapter 1603, Occupations Code, by adding Section 1603.206, as follows:

 

Sec. 1603.206.  MOBILE SHOPS.  (a)  Defines “mobile shop.”

 

(b)  Authorizes a barbershop, beauty shop, or other specialty shop licensed or permitted under this chapter (Regulation of Barbering and Cosmetology), Chapter 1601 (Barbers), or Chapter 1602 (Cosmetologists) to be a mobile shop.

 

(c)  Authorizes the Texas Commission of Licensing and Regulation to adopt rules to administer this section, including rules providing for certain items set forth in this subsection.

 

SECTION 2.  Effective date: upon passage or September 1, 2007.
