AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, counties and cities have different regulations regarding warning signage for pipelines.  The consolidation of jurisdiction over pipeline warning signs would be appropriate.

 

As proposed, S.B. 1013 transfers jurisdiction over warning signs for pipelines in Texas to the Railroad Commission of Texas.

 

RULEMAKING AUTHORITY

 

Rulemaking authority is expressly granted to the Railroad Commission of Texas in SECTION 1 (Section 91.702, Natural Resources Code) of this bill.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Chapter 91, Natural Resources Code, by adding Subchapter P, as follows:

 

SUBCHAPTER P. PIPELINE FACILITY WARNING SIGNS

 

Sec.  91.701.  COMMISSION JURISDICTION OVER PIPELINE FACILITY WARNING SIGNS.  (a) Defines "hazardous liquid."

 

(b) Provides that the Railroad Commission of Texas (commission) has exclusive jurisdiction over warning signs appurtenant to natural gas and hazardous liquid pipelines, gathering lines, and distribution facilities.

 

Sec.  91.702.  RULES.  Authorizes the commission to adopt all necessary rules governing warning signs described by section 91.701.

 

Sec. 91.703.  ADMINISTRATIVE PENALTY.  Provides that a violation of a rule adopted under this section is considered to be a violation of a provision of a rule that pertains to safety and is issued under this title for purpose of Section 81.0531 (Administrative Penalty).

 

SECTION 2.  Effective date: September 1, 2007.
