BACKGROUND AND PURPOSE

 

C.S.S.B. 1069 creates the Fort Bend Municipal Utility District No. 183, providing water and sewer service to residents living in an unincorporated area of the county.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1. Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 8208, as follows:

 

CHAPTER 8208. FORT BEND COUNTY MUNICIPAL UTILITY DISTRICT NO. 183.

 

Sets forth standard language for the creation of the Fort Bend Municipal Utility District (district) in Fort Bend County. Sets forth standards, procedures, requirements, and criteria for:

 

Creation, approval, and initial territory of the district (Sections 8208.001-8208.004);

 

Size, composition, names, election, and terms of the temporary board of directors and board of directors (Sections 8208.051-8208.056);

 

Powers and duties of the district (Sections 8208.101-8208.103); and

 

General financial provisions and authority to impose taxes and to issue bonds and obligations for the district (Sections 8208.151, 8208.201).

 

Sections reserved for expansion: 8208.005-8208.050, 8208.057-8208.100, 8208.104-8208.150, 8208.152-8208.200

 

SECTION 2. Sets forth the initial boundaries of the district.

 

SECTION 3. Provides that all requirements of the constitution of the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4. Effective date: September 1, 2007.
