AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

S.B. 1092 creates Somerset Municipal Utility District No. 2 (district).  Municipal utility districts (MUDs), authorized by Article 16, Section 59 and Article 3, Section 52 of the Texas Constitution, and governed by Chapters 49 (Provisions Applicable to All Districts) and 54 (Municipal Utility Districts), Water Code, are financing vehicles used by land owners and developers to pay for costs of public infrastructure including water, sewer, and drainage.  This bill adds authority to finance roadways, if approved by and built in compliance with standards set by San Jacinto County.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 8204, as follows:

 

CHAPTER 8204.  SOMERSET MUNICIPAL UTILITY DISTRICT NO. 2

 

Sets forth standard language for the creation of Somerset Municipal Utility District No. 2 (district) in San Jacinto County.  Sets forth standards, procedures, requirements, and criteria for:

 

Creation and approval of the district (Sections 8204.001-8204.020);

 

Size, composition, election, and terms of the board of directors of the district (Sections 8204.021-8204.100);

 

Powers and duties of the district (Sections 8204.101-8204.150);

 

General financial provisions and authority to impose taxes and to issue bonds and other obligations for the district (Sections 8204.151-8204.250); and

 

Division of the district into multiple districts (Sections 8204.251-8204.255).

 

Authorizes the use of eminent domain by the district.

 

SECTION 2.  Sets forth the initial boundaries of the district.

 

SECTION 3.  Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4.  Effective date: upon passage or September 1, 2007.
