AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

C.S.S.B. 1123 creates a management district on property adjacent to Reliant Park in the City of Houston. The management district will have the ability to finance certain services and facilities and contract with other entities to provide certain major mixed-use projects.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Sets forth the legislative findings regarding the Harris County Improvement District No. 8.

 

SECTION 2.  Amends Subtitle C, Title 4, Special District Local Laws Code, by adding Chapter 3848, as follows:

 

CHAPTER 3848.  HARRIS COUNTY IMPROVEMENT DISTRICT NO. 8

 

Sets forth standard language for the creation of the Harris County Improvement District No. 8 (district) in Harris County. Sets forth standards, procedures, requirements, and criteria for:

 

Creation, definitions, nature, and approval of the district (Sections 3848.001-3848.004);

 

Initial district territory, applicability of municipal management district law, and liberal construction of the chapter (Section 3848.005-3848.050);

 

Size, composition, election, and terms of the board of directors of the district (Sections 3848.051-3848.100);

 

Powers and duties of the district (Sections 3848.101-3848.150);

 

Public transit and parking facility creation and acquisition (Sections 3848.151-3848.200);

 

General financial provisions and authority to impose taxes and to issue bonds and obligations for the district (Sections 3848.201-3848.250); and

 

Dissolution of the district (Section 3848.251).

 

Does not authorize the use of eminent domain by the district.

 

SECTION 3. Sets forth the initial boundaries of the district.

 

SECTION 4. Authorizes the district to reimburse the cost of creating the district from assessments or other revenues created by the district.

 

SECTION 5. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 6. Effective date: upon passage or September 1, 2007.
