AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Current law provides every probate court, with the exception of Dallas County and certain Harris County probate courts, the option to hire an associate judge, if the presiding judge and the commissioners court agree to it.

 

As proposed, S.B. 1125 extends the option to hire an associate judge to Probate Court No. 4 of Harris County, with the approval of the presiding judge and the commissioners court.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to any state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 54.602, Government Code, as follows:

 

Sec.  54.602.  APPLICATION.  Provides that this subchapter does not apply to the statutory probate courts of Dallas County; or Probate Court No. 2 of Harris County, Texas.  Deletes existing text providing that Probate Courts Nos. 1 and 3 of Harris County are an exception to this subchapter.

 

SECTION 2.  Effective date: September 1, 2007.
