AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

As proposed, S.B. 1127 increases the penalty for disobeying, destroying, defacing, removing, or causing damage to county signs or traffic devices.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Sections 251.161(b) and (c), Transportation Code, as follows:

 

(b) Deletes an exception provided by Subsections (c) and (d). Increases to $200 from $50 the maximum amount for a fine for an offense punishable under this section (Violation of Subchapter; Offense).

 

(c) Authorizes an actor whose conduct constitutes an offense under this section and an offense under any other law to be prosecuted under either law. Deletes existing text relating to a person previously convicted one time of the offense.

 

SECTION 2. Repealer: Section 251.161(d) (relating to a person previously convicted two times of the offense), Transportation Code.

 

SECTION 3. Effective date: September 1, 2007.
