AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, only a registered voter of the district may serve on the board of supervisors of a fresh water supply district, while other similar districts only require that the director be a land owner within the district boundaries.

 

As proposed, S.B. 1178 requires a supervisor on the board of supervisors of a fresh water supply district to only own land within the boundaries of a fresh water supply district, rather than be a registered voter of the district.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 53.063, Water Code, as follows:

 

Sec. 53.063.  SUPERVISOR'S QUALIFICATIONS.   Requires a person to be a resident of this state, the owner of taxable property in the district, and at least 18 years of age, rather than solely a registered voter of the district, to be qualified for election as a supervisor of a fresh water supply district.

 

SECTION 2.  Makes application of this Act prospective.

 

SECTION 3.  Effective date: September 1, 2007.
