AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Under current law, legislators accrue service credit in the elected class of the Employees Retirement System of Texas.

 

As proposed, S.B. 1194 provides that membership in the elected class of the Employees Retirement System of Texas is limited to certain elected officials, including members of the legislature who first served as members of the legislature before September 1, 2007.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 812.002, Government Code, by amending Subsection (a) and adding Subsection (d), as follows:

 

(a)  Provides that membership in the elected class of the Employees Retirement System of Texas is limited to certain persons, including members of the legislature who first served as members of the legislature before September 1, 2007.

 

(d)  Provides that a person is not entitled to service credit, or any contribution under this subtitle (Employees Retirement System of Texas), for service in the elected class as a member of the legislature if the person first serves in the legislature on or after September 1, 2007.

 

SECTION 2.  Effective date: September 1, 2007.
