AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Police departments in many cities have experienced high levels of growth. Despite this fact, police departments are hindered in efforts to create additional assistant police chief positions because of the current law that states that a police department is only allowed to have as many assistant police chiefs as the department had as of January 1, 1983, plus one.

 

As proposed, S.B. 1243 changes this date to January 1, 1993 in order to allow police departments that acquired another assistant position on or before the new date to be able to acquire an additional assistant position if they see fit.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 143.014(c), Local Government Code, as follows:

 

(c) Prohibits the total number of persons in a police department appointed to the classification immediately below that of department head from exceeding the total number of persons, plus one, serving in that classification on January 1, 1993, rather than 1983. Sets forth the classification requirements of a fire department in a municipality. Provides that this subsection does not apply to a municipality that has adopted Chapter 174 (Fire and Police Employee Relations), unless the municipality specifically adopts the appointment procedure prescribed by this subsection through the collective bargaining process. Deletes existing text referencing Article 5154c-1, V.T.C.S.

 

SECTION 2. Effective date: upon passage or September 1, 2007.
