AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Current law requires the commissioners courts of Culberson and Hudspeth counties to each pay El Paso County $100 a month to be expended for the preparation and conduct of criminal affairs of the district attorney's office.  This fixed amount may not properly address the costs of conducting such affairs on the part of El Paso County. 

 

As proposed, S.B. 1379 requires Culberson and Hudspeth counties to reimburse El Paso County for certain costs related to the preparation and conduct of criminal affairs of the district attorney's office for Culberson and Hudspeth counties. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 43.120(d), Government Code, as follows:

 

(d)  Requires the commissioners courts of Culberson and Hudspeth counties to each reimburse El Paso County for the preparation and conduct of criminal affairs of the district attorney's office for Culberson and Hudspeth counties, rather than requiring those counties to pay El Paso County $100 a month to be expended on sworn claims of the district attorney approved by the Commissioners Court of El Paso County for said preparation and conduct.  Requires reimbursements provided under this subsection to be deposited and managed as provided by Sections 140.003(f) and (g), Local Government Code. 

 

SECTION 2.  Effective date: October 1, 2007.
