BACKGROUND AND PURPOSE

 

The Professional Prosecutors Act was enacted in 1979 to encourage prosecutors to concentrate their work solely on the state rather than maintain private practices.

 

As proposed, S.B. 1414 includes the district attorney for the 143rd Judicial District in the Professional Prosecutors Act.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Amends Section 46.002, Government Code, as follows:

 

Sec.  46.002.  PROSECUTORS SUBJECT TO CHAPTER.  Provides that this chapter (Professional Prosecutors) applies to the district attorney for the 143rd judicial district.

 

SECTION 2.  Amends Section 46.002, Government Code, effective January 1, 2009, as follows:

 

Sec.  46.002.  PROSECUTORS SUBJECT TO CHAPTER.  Provides that this chapter applies to the district attorney for the 143rd judicial district.

 

EFFECTIVE DATE

 

September 1, 2007.
