BACKGROUND AND PURPOSE

 

The West Fort Bend Management District (district) is a municipal district created by the 79th Legislature. The district provides services and amenities to the commercial property in the district, much like a commercial property owners association.  For several years prior to creation, commercial property owners in the cities of Richmond and Rosenberg, together with the respective city governments discussed options for supporting their businesses.  The creation of the district was determined to be the best way to implement their goals.

 

The district currently exists over the commercial properties along the key commercial corridors of the two cities.  As development progresses along the other corridors in the corporate limits and the extraterritorial jurisdictions of Richmond and Rosenberg, the cities would like the authority to request that the district annex additional commercial property into the district.

 

The purpose of S.B. 1439 is to authorize the West Fort Bend Management District to annex additional territories into the district.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

This bill amends Subchapter C, Chapter 3835, Special District Local Laws Code, by adding a new Section 3835.109 that has the heading "ANNEXATION IN OR NEAR CITY".  This new section authorizes the district to annex territory in the corporate limits or extraterritorial jurisdictions of the City of Rosenberg or the City of Richmond under certain conditions.  These conditions are that the governing body of the city requests the annexation of its territory by ordinance or resolution and the board holds a hearing to consider the city's request and the board determines that it is feasible, practicable, and to the district's advantage.  This new authority is in addition to the authority to annex territory under Subchapter C, Chapter 375, Local Government Code, and Subchapter J, Chapter 49, Water Code.  This new section prohibits the district from annexing a single-family residence under this section.

 

This bill provides for an effective date (upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007).
