AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
The West Fort Bend Management District is a municipal district created by the 79th Legislature, Regular Session. The district provides services and amenities to the commercial property in the district, much like a commercial property owners association. For several years prior to creation, commercial property owners in the cities of Richmond and Rosenberg, together with the respective city governments discussed options for supporting their businesses. The creation of the district was determined to be the best way to implement their goals.
The district currently exists over the commercial properties along the key commercial corridors of the two cities. As development progresses along the other corridors in the corporate limits and the extraterritorial jurisdictions of Richmond and Rosenberg, the cities would like the authority to request that the district annex additional commercial property into the district.
As proposed, S.B. 1439 authorizes the West Fort Bend Management District to annex additional territories into the district.
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Chapter 3835, Local Government Code [sic], by adding Section 3835.109, as follows:
Sec. 3835.109. ANNEXATION. (a) Authorizes the West Fort Bend Management District (district), in addition to the authority to annex territory under other laws, to annex territory located in the corporate limits or extraterritorial jurisdictions of the City of Rosenburg or the City of Richmond, at the request of those cities, respectively, in the manner set forth in this section.
(b) Requires the governing body in whose corporate limits or extraterritorial jurisdiction the territory is located to adopt a resolution or ordinance requesting the annexation. Requires the board of directors of the district (board) to conduct a public hearing and consider the request of the city.
(c) Authorizes the board to annex the territory into the district if the board determines that it is feasible, practical, and to the advantage of the district.
SECTION 2. Effective date: upon passage or September 1, 2007.
