AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, the Texas Building and Procurement Commission (TBPC) is required to perform duties related to the Governor's Mansion.  The 78th Legislature, 2003, transferred management and maintenance responsibilities for five properties from the Texas Historical Commission to TBPC.

 

As proposed, S.B. 1529 transfers the preservation and maintenance of the Governor's Mansion, the Gethsemane Church and Luther Hall, the Elrose Building, the Christianson-Leberman Building, and the Carrington-Covert House to the State Preservation Board (board).  This transfer is a recommendation of the Legislative Budget Board in its Effectiveness and Efficiency Report to the 80th Legislature.  Appropriations for maintenance and repairs would also need to be provided to the board.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 442.0071(e), Government Code, to authorize the State Preservation Board (board), rather than the State Purchasing and General Services Commission, and the governor's office (office) to exercise the powers and requires the board and office to perform the duties relating to the Governor's Mansion that are provided by applicable law, subject to the requirements of this section (Preservation and Maintenance of Governor's Mansion).

 

SECTION 2. Amends Chapter 443, Government Code, by adding Section 443.0073, as follows:

 

Sec. 443.0073. PRESERVATION AND MAINTENANCE OF CERTAIN STATE BUILDINGS. (a) Requires the board to preserve, maintain, and restore certain state buildings, their contents, and their grounds, subject to the Texas Historical Commission's duties to preserve, maintain, and restore the buildings and their grounds under other law.

 

(b) Establishes the locations of certain government buildings for purposes of this section.

 

SECTION 3. Amends Section 2165.007(b), Government Code, to require the Texas Building and Procurement Commission (commission) to provide certain facilities management services, and to provide that the duties of the commission do not apply to certain buildings, including any property maintained by the board under Section 443.0073.

 

SECTION 4. Effective date: September 1, 2007.
