BACKGROUND AND PURPOSE
Current law authorizes only historically underutilized business program participants to use "small business" as an additional evaluation criteria. The Dallas-Fort Worth Airport (DFW) only maintains a small and emerging business program and cannot use "small business" criteria in determining best value procurements.
S.B. 1618 authorizes DFW Airport to use the participation of small businesses as additional evaluation criteria in determining the best value for procurements.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
ANALYSIS
S.B. 1618 authorizes a joint board described in Section 22.074(d), Transportation Code, that awards contracts in the manner provided by this chapter (County and Municipal Airports), in addition to the considerations provided by Section 252.043(b), Local Government Code, to consider, in determining the best value for the board, the impact on the ability of the board to comply with laws, rules, and programs relating to contracting with a small business.
EFFECTIVE DATE
Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
