AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Currently, Section 227.041(c), Transportation Code, provides that all laws governing the acquisition of right-of-way for state highways apply to the acquisition of right-of-way for the Trans-Texas Corridor, but the statute is unclear regarding whether highway relocation assistance laws apply to such acquisition.
As proposed, S.B. 1657 amends Section 227.041(c), Transportation Code, to specify that laws related to relocation assistance apply to the acquisition of right-of-way for the Trans-Texas Corridor.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 227.041(c), Transportation Code, to provide that any law granting a power or imposing a duty related to providing relocation assistance to property owners from whom the Texas Department of Transportation acquires property applies to the acquisition of right-of-way for the Trans-Texas Corridor.
SECTION 2. Effective date: upon passage or September 1, 2007.
