BACKGROUND AND PURPOSE

 

The Travis-Creedmoor Municipal Utility District (district) will encompass an area of land inside the corporate limits of the Village of Creedmoor, which currently does not provide water and wastewater services.  The district is subject to a confirmation election.  The land to be located within the district will be developed for commercial, industrial, and residential uses.  Therefore, water, sewer, and drainage services need to be secured.

 

S.B. 1660 creates the district under Chapter 49 (Provisions Applicable to All Districts) and Chapter 54 (Municipal Utility Districts), Water Code, in order to purchase, acquire, or construct facilities for such services needed to serve current and future occupants of the land utilizing tax exempt bonds.  S.B. 1660 provides regulations regarding the creation, administration, powers, duties, operation, and financing of the district.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 8163, as follows:

 

CHAPTER 8163.  TRAVIS-CREEDMOOR MUNICIPAL UTILITY DISTRICT

 

Sets forth standard language for the creation of the Travis-Creedmoor County Municipal Utility District (district) in Travis County.  Sets forth standards, procedures, requirements, and criteria for:

 

Creation and approval of the district (Sections 8163.001-8163.050);

 

Size, composition, election, and terms of the board of directors of the district (Sections 8163.051-8163.100);

 

Powers and duties of the district (Sections 8163.101-8163.150); and

 

General financial provisions and authority to impose taxes and to issue bonds and obligations for the district (Sections 8163.151-8163.202).

 

Authorizes the use of eminent domain by the district.

 

SECTION 2.  Sets forth the initial boundaries of the district.

 

SECTION 3.  Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4.  Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
