AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

Current law allows a chiropractor to be one of the medical professionals that can clear a child for participation in extracurricular athletic activities.

As proposed, S.B. 1679 requires that physicians, physician assistants, or advanced practice nurses are the only medical professionals who can clear a student to participate in extracurricular athletic activities to ensure that the medical professionals allowing children to play sports have had training in identifying genetic cardiovascular disease.

RULEMAKING AUTHORITY

Rulemaking authority is expressly granted to the University Interscholastic League in SECTION 1 (Section 33.092, Education Code) of this bill.

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Subchapter D, Chapter 33, Education Code, by adding Section 33.092, as follows:

Sec. 33.092.  PHYSICAL EXAMINATION REQUIRED FOR PARTICIPATION IN EXTRACURRICULAR ATHLETIC ACTIVITY.  (a) Defines "physician," "physician assistant," and "advanced practice nurse."

(b) Prohibits a student from participating in extracurricular athletic activities sponsored by a school district unless the student has submitted a completed form to the school district indicating that he or she has received a physical examination by a physician, physician assistant, or advanced practice nurse.  Requires the form to be signed by the physician, physician assistant, or advanced practice nurse and indicate that the examination determined that the student does not have a medical condition that would make it hazardous for the student to participate in athletic activity.

(c) Requires the physical examination form required by Subsection (a) to be submitted to the school district before the student is authorized to participate in any athletic practice, scrimmage, game, or match.

(d) Requires the University Interscholastic League to adopt rules to implement this section.

SECTION 2.  Effective date: September 1, 2007.
