AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Current law allows a chiropractor to be one of the medical professionals that can clear a child for participation in extracurricular athletic activities. 

 

C.S.S.B. 1679 requires that physicians, physician assistants, or advanced practice nurses are the only medical professionals who can clear a student to participate in extracurricular athletic activities to ensure that the medical professionals allowing children to play sports have had training in identifying genetic cardiovascular disease.

 

RULEMAKING AUTHORITY

 

Rulemaking authority is expressly granted to the University Interscholastic League in SECTION 1 (Section 33.092, Education Code) of this bill.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subchapter D, Chapter 33, Education Code, by adding Section 33.092, as follows:

 

Sec. 33.092.  PHYSICAL EXAMINATION REQUIRED FOR PARTICIPATION IN EXTRACURRICULAR ATHLETIC ACTIVITY.  (a) Defines "advanced practice nurse," "physician," and "physician assistant."

 

(b) Prohibits a student from participating in extracurricular athletic activity, including an athletic practice, scrimmage, game, or match, sponsored or sanctioned by the University Interscholastic League (UIL) unless the student has submitted a completed form to the school district the student attends indicating that he or she has received a physical examination conducted by a physician, physician assistant, or advanced practice nurse.  Requires the form to be signed by the physician, physician assistant, or advanced practice nurse and include a statement that, based on the examination, the physician, physician assistant, or advanced practice nurse has determined that the student does not have a medical condition that would make participation in the athletic activity hazardous for the student.

 

(c) Requires UIL to adopt rules to administer this section.

 

SECITON 2.  Makes application of this Act prospective to the 2007-2008 school year.

 

SECTION 3.  Effective date: upon passage or September 1, 2007.
