AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

As proposed, S.B. 1752 amends the enabling statute of the Midland County Hospital District by moving the hospital board elections from May to November, raising the expenditure threshold of construction and purchasing contract bids that require public notice from $10,000 to $25,000, increasing the time period for which a bank may be designated as a depository of district funds from two years to four years, and authorizing the hospital to donate old or unneeded personal property to government entities or charitable organizations provided that the donation serves a public purpose.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 5(g), Chapter 112, Acts of the 65th Legislature, Regular Session, 1977, as follows:

 

(g) Requires members of the board of directors (board) of the Midland County Hospital District (district) to be elected on the November uniform election date under Section 41.001 (Uniform Election Dates), Election Code, rather than the first Saturday in May, of each even-numbered year.  Deletes existing text relating to previous election requirements.

 

SECTION 2.  Amends Section 11, Chapter 112, Acts of the 65th Legislature, Regular Session, 1977, as follows:

 

Sec. 11.  (a)  Creates this subsection from existing text.

 

(b)  Authorizes the board to donate to another governmental entity or to a charitable organization any surplus personal property or equipment if the donation serves a public purpose and is accompanied by adequate consideration.

 

SECTION 3.  Amends Section 12, Chapter 112, Acts of the 65th Legislature, Regular Session, 1977, to authorize all contracts by the district for construction or purchases involving the expenditure of more than $25,000, rather than $10,000, to be made only after advertising in the manner provided by Chapter 252 (Purchasing and Contracting Authority of Municipalities), Local Government Code. 

 

SECTION 4.  Amends Section 13(a), Chapter 112, Acts of the 65th Legislature, Regular Session, 1977, as follows:

 

(a)  Requires the board to name one or more banks within its boundaries to serve as depository for the funds of the district for a period of four, rather than two, years.  Requires the depository contract to be awarded to, rather than let with, the bank or banks offering the most favorable terms and conditions for handling the district's money.

 

SECTION 5.  Requires the members of the board to adjust the terms of office of directors to conform to the change of the election date made under Section 5(g), Chapter 112, Acts of the 65th Legislature, Regular Session, 1977, as amended by this Act.

 

SECTION 6.  Effective date: September 1, 2007.
