AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Currently, school districts do not provide a comprehensive education component to educate students on what constitutes inappropriate conduct by an adult.
As proposed, S.B. 1792 requires the commissioner of education to develop a safety education program for use in public schools. The bill requires this program to provide for age-appropriate curricula on recognizing and reporting inappropriate conduct by an adult, including verbal comments, physical contact, photography, and online communications.
RULEMAKING AUTHORITY
Rulemaking authority is expressly granted to the commissioner of education in SECTION 1 (Section 28.010, Education Code) of this bill.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Subchapter A, Chapter 28, Education Code, by adding Section 28.010, as follows:
Sec. 28.010. SAFETY EDUCATION PROGRAM. Requires the commissioner of education (commissioner) to develop a safety education program (program) for use in all school districts which includes age-appropriate curricula and educational materials about recognizing and reporting inappropriate conduct by an adult including, but not limited to, verbal comments, physical contact, photography, and online communications. Requires the commissioner by rule to establish the minimum amount of time during the school year that a school district must provide program instruction.
SECTION 2. Requires the commissioner to develop or adopt the program as provided by Section 28.010, Education Code, as added by this Act, not later January 1, 2008.
SECTION 3. Effective date: upon passage or September 1, 2007.
