AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

As proposed, S.B. 1808 creates the Metroplex Area Mobility Authority, with all the powers of a regional mobility authority, a regional transportation authority, and a local government, relating to county and municipal airports, in the territory of Collin, Dallas, Denton, Ellis, Johnson, Kaufman, Parker, Rockwell, Tarrant, and Wise counties, and requires these counties to comprise a single Texas Department of Transportation district.  The bill consolidates current transportation entities in these counties by transferring all assets, rights, and obligations of those entities to the authority.  The bill also authorizes the authority to impose a sales tax on gasoline sold within the authority’s territory, and to collect 85 percent of the state fuel tax within its territory.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 201.105(b), Transportation Code, to require the Texas Transportation Commission (TTC), in determining the boundaries for the Texas Department of Transportation (TxDOT) districts, to include certain counties in a single district.

 

SECTION 2.  Amends Subtitle G, Title 6, Transportation Code, by adding Chapter 371, as follows:

 

CHAPTER 371.  METROPLEX AREA MOBILITY AUTHORITY

 

Sets forth standard language for the creation of the Metroplex Area Mobility Authority (authority) in Collin, Dallas, Denton, Ellis, Johnson, Kaufman, Parker, Rockwell, Tarrant, and Wise counties.  Sets forth standards, procedures, requirements and criteria for:

 

Creation and size of the authority (Sections 371.001-371.002);

 

Composition, term length, and compensation of the board of directors of the authority (Section 371.003);

 

Location of the authority’s headquarters (Section 371.004);

 

General powers and duties of the authority (Section 371.005);

 

Powers relating to airports (Section 371.006);

 

Authority to impose, collect, compute, enforce, use, and abolish certain motor fuel sales taxes (Sections 371.051-.371.063)

 

Authority relating to the imposition, computation, administration, governance, and abolition of a sales and use tax (Sections 371.101-371.105).

 

SECTION 3.  Amends Subchapter F, Chapter 162, Transportation Code, by adding Section 162.506, to set forth the comptroller of public accounts’ duties regarding payment to the authority.

 

SECTION 4.  Requires TTC to conform the boundaries of the TxDOT districts to conform to Section 201.105(b), Transportation Code, as amended by this Act, as soon as practicable after this Act’s effective date but not later than January 1, 2008.

 

SECTIONS 5 - 6.  Transfers all of the assets, rights, obligations, property, and duties of certain prior transportation entities in the affected counties to the authority, with all related employees, agreements, contracts, and other items.

 

SECTION 7.  Effective date: upon passage or September 1, 2007.
