BACKGROUND AND PURPOSE

 

Currently, Kenedy, Kleberg, and Nueces counties are served by the 105th judicial district attorney, based in Nueces County.  The caseload amount has increased in all three counties, and it would benefit all of the citizens of these counties if a separate district attorney’s office were created for Kenedy and Kleberg counties. 

 

The bill creates a separate district attorney for Kenedy and Kleberg counties and assigns the 105th district attorney to Nueces County only.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Amends Section 43.148, Government Code, as follows:

 

Sec. 43.148.  105TH JUDICIAL DISTRICT.  (a)  Provides that the voters of Nueces County elect a district attorney for the 105th Judicial District.  Deletes the provision that the district attorney serves the district courts of Kleberg and Kenedy counties.  Makes conforming and non-substantive changes.

 

(b)  and (c)  Makes conforming changes.

 

SECTION 2.  Amends Subchapter B, Chapter 43, Government Code, by adding Section 43.182, as follows:

 

Sec. 43.182.  DISTRICT ATTORNEY FOR KLEBERG AND KENEDY COUNTIES. 

Sets forth the standard language for the creation, duties, and supplementary compensation of the district attorney for Kleberg and Kenedy counties. 

 

SECTION 3.  Amends Section 46.002, Government Code, to make conforming changes.

 

SECTION 4.  Amends Section 46.002, Government Code, effective January 1, 2009, to make conforming changes.

 

EFFECTIVE DATE

 

September 1, 2007.
