AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Current law allows for a one-year temporary teaching certificate for teachers to use while the State Board for Educator Certification (SBEC) determines what tests the teacher is required to take to become certified to teach in Texas.

 

As proposed, S.B. 1912 requires the temporary certification period of an educator employed by a school district that has constructed or expanded at least one instructional facility as a result of increased student enrollment due to action taken under the Defense Base Closure and Realignment Act of 1990 to expire one year after SBEC informs the educator of the examination or examinations the on which educator is required to perform successfully to receive a standard certificate.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to any state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends this Section 21.052, Education Code, by adding Subsections (e) and (f), as follows:

 

(e) Authorizes the State Board for Educator Certification (board) to issue a temporary certificate under this section to an educator who holds a degree required by Subsection (a)(1) (relating to the requirement that an educator hold a degree issued by certain institution) and a certificate or other credential required by Subsection (a)(2) (relating to the requirement that an educator hold an appropriate certificate or other credential issued by another state or country) but who has not satisfied the requirements prescribed by Subsection (a)(3) (relating to the requirement that an educator perform satisfactorily on certain examinations).  Authorizes the board, subject to Subsection (e), to specify the term of a temporary certificate issued under this subsection.

 

(f) Prohibits a temporary certificate issued under Subsection (e) to an educator employed by a school district that has constructed or expanded at least one instructional facility as a result of increased student enrollment due to action taken under the Defense Base Closure and Realignment Act of 1990 (10 U.S.C. Section 2687) from expiring before the first anniversary of the date on which the board completes the review of the educator's credentials and informs the educator of the examination or examinations under Section 21.048 (Certification Examinations) on which the educator is required to perform successfully to receive a standard certificate.

 

SECTION 2.  Effective date: upon passage or September 1, 2007.
