BACKGROUND AND PURPOSE

 

Currently, the Gastonia-Scurry Water Supply Corporation, which is governed by a board of directors elected by the members of the corporation, provides water service within a portion of Kaufman County.

 

S.B. 1942 creates the Gastonia-Scurry Special Utility District and dissolves the Gastonia-Scurry Water Supply Corporation.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Amends Subtitle C, Title 6, Special District Local Laws Code, by adding Chapter 7213, as follows:

 

CHAPTER 7213.  GASTONIA-SCURRY SPECIAL UTILITY DISTRICT

 

Sets forth standard language for the creation of the Gastonia-Scurry Special Utility District in Kaufman County (district). Sets forth standards, procedures, requirements, and criteria for:

 

Creation and approval of the district (Sections 7213.001-7213.005);

 

Size, composition, election, and terms of the board of directors of the district (Section 7213.021-7213.022 and 7213.051);

 

Transfer of assets and dissolution of the Gastonia-Scurry Water Supply Corporation and expiration of subchapter (Sections 7213.023-7213.024); and

 

Powers and duties of the district, including authority to impose an impact fee (Sections 7213.101-7213.102).

 

Sections 7213.006-7213.020, 7213.025-7213.050 and 7213.052-7213.100 reserved for expansion.

 

SECTION 2. Sets forth the initial boundaries of the district.

 

SECTION 3. Provides that all requirement of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4. Effective date:  Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
