AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
As proposed, S.B. 1945 creates the Spectrum Management District (district) as a political subdivision of this state to administer and provide funding for improvement projects and services in the district, which is located in the corporate limits of the City of Pearland and in Harris County.
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Subtitle C, Title 4, Special District Local Laws Code, by adding Chapter 3840, as follows:
CHAPTER 3840. SPECTRUM MANAGEMENT DISTRICT
Sets forth standard language for the creation of the Spectrum Management District (district). Sets forth standards, procedures, requirements, and criteria for:
Creation and approval of the district (Sections 3840.001-3840.008);
Size, composition, election, and terms of the board of directors of the district (Sections 3840.051-3840.056);
Powers and duties of the district (Sections 3840.101-3840.107);
General financial provisions and authority to impose taxes and to issue bonds and obligations for the district (Sections 3840.151-3840.205); and
Dissolution of the district (Section 3840.251).
Prohibits the use of eminent domain by the district.
SECTION 2. Sets forth the initial boundaries of the district.
SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.
SECTION 4. Effective date: upon passage or September 1, 2007.
