BACKGROUND AND PURPOSE

 

S.B. 1954 creates Waller County Municipal Utility District No. 2 in the unincorporated areas of Waller County and partially within the extraterritorial jurisdiction of the City of Brookshire. Currently, the land within the boundaries of the proposed district is undeveloped.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 8236, as follows:

 

CHAPTER 8236.  WALLER COUNTY MUNICIPAL UTILITY DISTRICT NO. 2

 

Sets forth standard language for the creation of the Waller County Municipal Utility District No. 2 (district) in Waller County. Sets forth standards, procedures, requirements, and criteria for:

 

Creation and approval of the district and the effect of the district on the Brookshire-Katy Drainage District of Waller County (Sections 8236.001-8236.006);

 

Size, composition, election, and terms of the board of directors of the district (Sections 8236.051-8236.052);

 

Powers and duties of the district (Sections 8236.101-8236.104); and

 

General financial provisions and authority to impose taxes and to issue bonds and obligations for the district (Sections 8236.151-8236.203).

 

Sections 8236.007-8236.050, 8236.053-8236.100, 8236.105-8236.150 and 8236.153-8236.200 reserved for expansion.

 

SECTION 2. Sets forth the initial boundaries of the district.

 

SECTION 3. Provides that all requirement of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4. Effective date:  Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
