BACKGROUND AND PURPOSE

 

As proposed, S.B. 1964 creates the Montgomery County Municipal Utility District No. 114 (district).  Currently, the land located within the boundaries of the proposed district is undeveloped.  The territory of the district would lie in the unincorporated areas of Montgomery County.  The district would have all of the powers granted to the municipal utility districts operating pursuant to Chapters 49 (Provisions Applicable to All Districts) and 54 (Municipal Utility Districts), Water Code, with road powers pursuant to Article 3, Section 52 (Counties, Cities or Other Political Corporations or Subdivisions; Lending Credits; Grants; Bonds) of the Texas Constitution.

 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 8210, as follows:

 

CHAPTER 8210.  MONTGOMERY COUNTY MUNICIPAL UTILITY DISTRICT NO. 114

 

Sets forth standard language for the creation of the Montgomery County Municipal Utility District No. 114 (district) in Montgomery County.  Sets forth standards, procedures, requirements, and criteria for:

 

Creation and approval of the district (Sections 8210.001-8210.005)

 

Size, composition, election, and terms of the board of directors of the district (Sections 8210.051-8210.052);

 

Power and duties of the district (Section 8210.101-8210.105); and

 

General financial provisions and authority to impose taxes and to issue bonds and obligations for the district (Sections 8210.151-8210.204, 8210.201- 8201.204).

 

 

Authorizes the use of eminent domain by the district.

 

Sections reserved for expansion: 8210.006-8210.050, 8210.053-8210.100, 8210.106-8210.150, 8210.153-8210.200

 

SECTION 2.  Sets forth the initial boundaries of the district.

 

SECTION 3.  Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4.  Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
