BACKGROUND AND PURPOSE

 

As proposed, S.B. 1965 creates the Montgomery County Municipal Utility District No. 121 in the unincorporated area of Montgomery County. The district will have all of the powers granted to municipal utility districts pursuant to Chapters 49 (Provisions Applicable to All Districts) and 54 (Municipal Utility Districts), Water Code. The district will also have road powers pursuant to Article III, Section 52, Texas Constitution.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Subtitle F, Title 6, Special District Local Laws Code, is amended by adding Chapter 8211, as follows:

 

CHAPTER 8211.  MONTGOMERY COUNTY MUNICIPAL UTILITY DISTRICT NO. 121

 

SUBCHAPTER A. GENERAL PROVISIONS

 

Sets forth standard language for the creation of the Montgomery County Municipal Utility District No. 121 (district) in Montgomery County. Sets forth standards, procedures, requirements, and criteria for:

 

Creation and approval of the district (Sections 8211.001-8211.005);

 

Size, composition, election, and terms of the board of directors of the district (Sections 8211.051-8211.052);

 

Powers and duties of the district limitation on the use of eminent domain (Sections 8211.101-8211.105);

 

General financial provisions and authority to impose taxes and to issue bonds and obligations for the district (Sections 8211.151-8211.152, 8211.201-8211.204).

 

Authorizes the use of eminent domain by the district.

 

Sections reserved for expansion 8211.006-8211.50, 8211.053-8211.100, 8211.106- 8211.150,   8211.153-821.200

 

SECTION 2. Sets forth the initial boundaries of the district.

 

SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4. Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
