AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
S.B. 1966 creates the Montgomery County Municipal Utility District No. 123 in the unincorporated area of Montgomery County. The district will have all of the powers granted to municipal utility districts pursuant to Chapters 49 (Provision Applicable to All Districts) and 54 (Municipal Utility Districts), Water Code. The district will also have road powers pursuant to Article III, Section 52, Texas Constitution.

SECTION 1. Subtitle F, Title 6, Special District Local Laws Code, is amended by adding Chapter 8206, as follows:
CHAPTER 8206. MONTGOMERY COUNTY MUNICIPAL UTILITY DISTRICT NO. 123
SUBCHAPTER A. GENERAL PROVISIONS
Sets forth standard language for the creation of the Montgomery County Municipal Utility District No. 123 (district) in Montgomery County. Sets forth standards, procedures, requirements, and criteria for:
Creation and approval of the district (Sections 8206.001-8206.050);
Size, composition, election, and terms of the board of directors of the district (Sections 8206.051-8206.100);
Powers and duties of the district and limitation on the use of eminent domain (Sections 8206.101-8206.150); and
General financial provisions and authority to impose taxes and to issue bonds and obligations for the district (Sections 8206.151-8206.204).
Authorizes the use of eminent domain by the district.
SECTION 2. Sets forth the initial boundaries of the district.
SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.
SECTION 4. Effective date: upon passage or September 1, 2007.
