AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

As proposed, S.B. 1971 creates Burnet County Water Control and Improvement District No. 1 (district) and enumerates its powers, duties, and obligations.  The bill also combines the traditional powers of a water control and improvement district governed by Chapters 49 and 51, Water Code, and a municipal utility district, governed by Chapters 49 and 54, Water Code.  In addition the bill grants the district road powers pursuant to Article 3, Section 52, Texas Constitution.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to any state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle I, Title 6, Special District Local Laws Code, by adding Chapter 9015, as follows:

 

CHAPTER 9015.  BURNET COUNTY WATER CONTROL AND IMPROVEMENT DISTRICT NO.  1

 

Sets forth standard language for the creation of the Water Control and Improvement District No.  1 (district) in Burnet County. Sets forth standards, procedures, requirements, and criteria for:

 

Creation, nature, initial district territory, and approval of the district (Sections 9015.001-9015.050);

 

Size, composition, election, and terms of the board of directors of the district (Sections 9015.051-9015.100);  and

 

Powers and duties of the district (Sections 9015.101-9015.102).

 

Authorizes the use of eminent domain by the district.

 

SECTION 2. Sets forth the initial boundaries of the district.

 

SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4. Effective date: upon passage or September 1, 2007.
