BACKGROUND AND PURPOSE

 

S.B. 1977 creates Fort Bend County Municipal Utility District No. 189 (the “district”).  Currently, the land located within the boundaries of the proposed district is undeveloped.  The territory of the district would lie within the extraterritorial jurisdiction of the City of Alvin and in Fort Bend County.  The district would have all of the powers granted to municipal utility districts operating pursuant to Chapters 49 and 54, Texas Water Code.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 8210, as follows:

 

CHAPTER 8210.  FORT BEND COUNTY MUNICIPAL UTILITY DISTRICT NO. 189

 

Sets forth standard language for the creation of the Fort Bend County Municipal District No. 189 (district). Sets forth standards, procedures, requirements, and criteria for:

 

Creation and approval of the district (Sections 8210.001-8210.005);

 

Size, composition, election, and terms of the board of directors of the district (Sections 8210.051-8210.053);

 

Powers and duties of the district and compliance with municipal consent ordinances or resolutions (Sections 8210.101-8210.103); and

 

General financial provisions and authority to impose taxes and issue bonds and obligations for the district (Sections 8210.151-8210.202).

 

Authorizes the use of eminent domain by the district.

 

Sections reserved for expansion:  8210.006-8210.050, 8210.054-8210.100, 8210.104-8210.150, 8210.153-8210.200.

 

SECTION 2. Sets forth the initial boundaries of the district.

 

SECTION 3. Provides that all requirement of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4. Effective date: Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
