BACKGROUND AND PURPOSE

 

S.B. 1978 creates the Fort Bend County Levee Improvement District No. 19 to build roads in an unincorporated area of Fort Bend County.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Amends Subtitle E, Title 6, Special District Local Laws Code, by adding Chapter 7804, as follows:

 

CHAPTER 7804.  FORT BEND COUNTY LEVEE IMPROVEMENT DISTRICT NO. 19

 

Sets forth standard language for the creation of the Fort Bend County Levee Improvement District No. 19 (district) in Fort Bend County. Sets forth standards, procedures, requirements, and criteria for:

 

Creation, definitions, nature, and approval of the district (Sections 7804.001-7804.003);

 

Powers and duties of the district (Sections 7804.051-7804.052); and

 

General financial provisions and authority to impose taxes and to issue bonds and obligations for the district (Sections 7804.101).

 

Authorizes the use of eminent domain by the district.

 

Sections reserved for expansion: 7084.004-7804.050, 7084.053-7084.100

 

SECTION 2. Provides that the Fort Bend Levee Improvement District No. 19 retains all the rights, powers, privileges, authority, duties, and functions that it had before the effective date of this Act.

 

SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4. Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
