BACKGROUND AND PURPOSE

 

 S.B. 1986 amends the powers of the Cinco Southwest Municipal Utility District No. 1 to provide the district with limited road powers. Currently the district provides water, sewer, drainage, and park facilities to land located within the extraterritorial jurisdiction of the City of Houston and in Fort Bend County.

 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 8224, as follows:

 

CHAPTER 8224.  CINCO SOUTHWEST MUNICIPAL UTILITY DISTRICT NO. 1

 

Sets forth standard language granting authority to the Cinco Southwest Municipal Utility District No. 1 (district) in   Fort Bend County. Sets forth standards, procedures, requirements, and criteria for:

 

Definitions, nature, and purpose of the district (Sections 8224.001-8224.003);

 

Powers and duties of the district including authority relating to road projects (Sections 8224.051-8224.052); and

 

Authority to impose taxes and to issue bonds and obligations for the district (Section 8224.101).

 

Sections reserved for expansion: 8224.004-8224.050, 8224.053-8224.100

 

SECTION 2. Provides that the district retains all rights, powers, privileges, authority, duties, and functions that it had before the effective date of this act.

 

SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4. Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
