AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

As proposed, S.B. 1986 amends the powers of the Cinco Southwest Municipal Utility District No. 1 to provide the district with limited road powers. Currently the district provides water, sewer, drainage, and park facilities to land located within the extraterritorial jurisdiction of the City of Houston and in Fort Bend County.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 8224, as follows:

 

CHAPTER 8224.  CINCO SOUTHWEST MUNICIPAL UTILITY DISTRICT NO. 1

 

Sets forth standard language granting authority to the Cinco Southwest Municipal Utility District No. 1 (district) in Fort Bend County. Sets forth standards, procedures, requirements, and criteria for:

 

Definitions, nature, and purpose of the district (Sections 8224.001-8224.050);

 

Powers and duties of the district including authority relating to road projects (Sections 8224.051-8224.100); and

 

Authority to impose taxes and to issue bonds and obligations for the district (Sections 8224.101).

 

Authorizes the use of eminent domain by the district.

 

SECTION 2. Provides that the district retains all rights, powers, privileges, authority, duties, and functions that it had before the effective date of this act.

 

SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4. Effective date: upon passage or September 1, 2007.
