AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

S.B. 1988 grants the Cinco Southwest Municipal Utility District No. 3 limited road powers, including the use of eminent domain.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 8226, as follows:

 

CHAPTER 8226. CINCO SOUTHWEST MUNICIPAL UTILITY DISTRICT NO. 3

 

Sets forth standard language granting additional authority to the Cinco Southwest Municipal Utility District No. 3 (district). Sets forth standards, procedures, requirements, and criteria for:

 

Definitions, nature, and purpose of the district (Sections 8226.001-8226.050);

 

Powers and duties of the district, including authority relating to road projects (Sections 8226.051-8226.100); and

 

General financial provisions and authority to impose a tax and issue bonds and obligations for the district (Section 8226.101).

 

Authorizes the use of eminent domain by the district.

 

SECTION 2. Provides that the district retains all the rights, powers, privileges, authority, duties, and functions that it had before the effective date of this Act.

 

SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4. Effective date: upon passage or September 1, 2007.
