BACKGROUND AND PURPOSE
S.B. 1989 grants the Cinco Southwest Municipal Utility District No. 4 limited road powers, including the use of eminent domain.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
ANALYSIS
SECTION 1. Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 8227, as follows:
CHAPTER 8227. CINCO SOUTHWEST MUNICIPAL UTILITY DISTRICT NO. 4
Sets forth standard language granting additional authority to the Cinco Southwest Municipal Utility District No. 4 (district). Sets forth standards, procedures, requirements, and criteria for:
Definitions, nature and purpose of the district (Sections 8227.001-8227.003);
Powers and duties of the district, including authority relating to road projects (Sections 8227.051-8227.052); and
Authority to impose a tax and issue bonds and obligations for the district (Section 8227.101).
Sections reserved for expansion: 8227.004-8227.050, 8227.053-8227.100
SECTION 2. Provides that the district retains all the rights, powers, privileges, authority, duties, and functions that it had before the effective date of this Act.
SECTION 3. Provides that all requirement of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.
SECTION 4. Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
