AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

C.S.S.B. 1997 creates the Galveston County Municipal Utility District No. 65 (district) in Galveston County to encompass an undeveloped area of land.  The district will lie within the City of Texas City and Galveston County.  It is necessary to create the district under Chapters 49 and 54, Water Code.  This bill grants road powers under Article 3, Section 52 of the Texas Constitution.  This bill empowers the district to use eminent domain and to impose and issue taxes and bonds.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 8216, as follows:

 

CHAPTER 8216.  GALVESTON COUNTY MUNICIPAL UTILITY DISTRICT NO. 65

 

Sets forth standard language for the creation of the Galveston County Municipal Utility District No. 65 (district) in Galveston County.  Sets forth standards, procedures, requirements, and criteria for:

 

Creation, definitions, nature, and approval of the district (Sections 8216.001-8216.050);

 

Size, composition, election, and terms of the board of directors of the district (Sections 8216.051-8216.100);

 

Powers and duties of the district (Sections 8216.101-8216.150); and

 

General financial provisions and authority to impose taxes and to issue bonds and obligations for the district (Sections 8216.151-8216.203).

 

Authorizes the use of eminent domain by the district.

 

SECTION 2. Sets forth the initial boundaries of the district.

 

SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4. Effective date: upon passage or September 1, 2007.
