AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
S.B. 2008 creates the Comal County Special Improvement District No. 1 and provides for powers of taxation including ad valorem, hotel occupancy, assessments, and sales tax. Other powers include management district powers including road projects. The proposed district is located adjacent to existing Cibolo Canyons Special Improvement District, a public improvement district created by Bexar County. The purpose of the district will be to provide necessary public infrastructure to the area and to support and encourage economic development. S.B. 2008 provides regulations regarding the creation, administration, powers, duties, operation, and financing of the district.

SECTION BY SECTION ANALYSIS
SECTION 1. Amends Subtitle C, Title 4, Special District Local Laws Code, by adding Chapter 3855, as follows:
CHAPTER 3855. COMAL COUNTY SPECIAL IMPROVEMENT DISTRICT NO. 1
Sets forth standard language for the creation of the Comal County Special Improvement District No. 1 (district) in Comal County. Sets forth standards, procedures, requirements, and criteria for:
Creation and approval of the district (Sections 3855.001 - 818.050);
Size, composition, appointment procedure, and terms of the board of directors of the district (Section 3855.051 – 3855.100);
Powers and duties of the district (Section 3855.101 - 3855.150); and
General financial provisions and authority to impose taxes and to issue bonds and obligations for the district (Sections 3855.151 - 3855.202).
Prohibits the use of eminent domain by the district.
SECTION 2. Sets forth the initial boundaries of the district.
SECTION 3. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.
SECTION 4. Effective date: upon passage or September 1, 2007.
