AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

As proposed, S.B. 2044 creates the Harris County Improvement District No. 9 to provide transportation solutions, public safety, environmental and urban design, and business development in the Hobby Airport area.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle C, Title 4, Special District Local Laws Code, by adding Chapter 3859, as follows:

 

CHAPTER 3859.  HARRIS COUNTY IMPROVEMENT DISTRICT NO. 9

 

Sets forth standard language for the creation of the Harris County Improvement District No. 9 (district).  Sets forth standards, procedures, requirements, and criteria for:

 

Creation and approval of the district (Sections 3859.001-3859.050);

 

Size, composition, election, and terms of the board of directors of the district (Sections 3859.051-3859.100);

 

Powers and duties of the district (Sections 3859.101-3859.200);

 

General financial provisions and authority to impose taxes and issue bonds and obligations for the district (Sections 3859.201-3859.250); and

 

Dissolution of the district (Section 3859.251).

 

Prohibits the use of eminent domain by the district.

 

SECTION 2.  Sets forth the initial boundaries of the district.

 

SECTION 3.  Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4.  Provides that Section 313.006 (Notice for Laws Establishing Municipal Management District), Government Code, does not apply to this Act.

 

SECTION 5.  Effective date: upon passage or September 1, 2007.
