AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

As proposed, S.B. 2052 creates the Northern Trinity Groundwater Conservation District (district) in Tarrant County.  The district is a proactive response to address and ensure the protection of groundwater resources for the citizens of Tarrant County.  The district encompasses the entire county.  The county commissioners will appoint one board of directors from each of the four county commissioner precincts. The county judge will appoint the fifth director.  The district will be fee based and will not have authority to impose taxes, issue bonds, or exercise the power of eminent domain.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle H, Title 6, Special District Local Laws Code, by adding Chapter 8820, as follows:

 

CHAPTER 8820.  NORTHERN TRINITY GROUNDWATER CONSERVATION

DISTRICT

 

Sets forth standard language for the creation of the Northern Trinity Groundwater Conservation (district) in Tarrant County. Sets forth standards, procedures, requirements, and criteria for:

 

Creation, definitions, nature, and approval of the district (Sections 8820.001-8820.050);

 

Size, composition, election, and terms of the board of directors of the district (Sections 8820.051-8820.100);

 

Powers and duties of the district (Sections 8820.101-8820.150); and

 

General financial provisions, prohibiting the imposition of taxes or the issuance of bonds (Section 8820.151).

 

Prohibits the use of eminent domain by the district.

 

SECTION 2. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 3. Effective date: upon passage or September 1, 2007.
