AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

C.S.S.B. 2055 creates the Harris County Improvement District No. 10 (district).  This bill grants the district authority relating to road powers and the imposition of taxes by and the issuance of bonds and obligations for the district.  C.S.S.B. 2055 prohibits the use of eminent domain by the district.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle C, Title 4, Special District Local Laws Code, by adding Chapter 3860, as follows:

 

CHAPTER 3860.  HARRIS COUNTY IMPROVEMENT DISTRICT NO. 10

 

Sets forth standard language for the creation of the Harris County Improvement District No. 10 (district). Sets forth standards, procedures, requirements, and criteria for:

 

Creation and approval of the district (Sections 3860.001-3860.050);

 

Size, composition, election, and terms of the board of directors of the district (Sections 3860.051-3860.100);

 

Powers and duties of the district, including road powers and public transit system and parking facilities (Sections 3860.101-3860.200);

 

Financial provisions and authority to imposes taxes and issue bonds and obligations for the district (Sections 3860.201-3860.250); and

 

Dissolution of the district (Section 3860.251).

 

Prohibits the use of eminent domain by the district.

 

SECTION 2.  Sets forth the initial boundaries of the district.

 

SECTION 3.  Authorizes the district to reimburse the cost of creating the district from assessments or other revenue created by the district.

 

SECTION 4.  Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 5.  Provides that Section 313.006 (Notice for Laws Establishing Municipal Management Districts) does not apply to this Act.

 

SECTION 6.  Effective date: upon passage or September 1, 2007.
