A BILL TO BE ENTITLED
AN ACT
relating to disclosure by a violent offender who operates an online
business; providing a criminal penalty.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter D, Chapter 35, Business & Commerce
Code, is amended by adding Section 35.64 to read as follows:
       Sec. 35.64.  DISCLOSURE BY VIOLENT OFFENDER OPERATING ONLINE
BUSINESS. (a) This section applies only to a person who:
             (1)  has been convicted of or received a grant of
deferred adjudication for an offense described by Section 3g,
Article 42.12, Code of Criminal Procedure; and
             (2)  in connection with the conviction or grant of
deferred adjudication, was subsequently discharged, paroled,
placed in a nonsecure community program for juvenile offenders, or
placed on juvenile probatio
n, community supervision, or mandatory
supervision.
       (b)  A person described by Subsection (a) who operates an
Internet website in this state for the purpose of selling a good or
service shall include on the website, in a conspicuous size, the
following notice:
       "THE OPERATOR OF THIS WEBSITE HAS BEEN CONVICTED OF OR
RECEIVED A GRANT OF DEFERRED ADJUDICATION FOR AN OFFENSE DESCRIBED
BY SECTION 3g, ARTICLE 42.12, CODE OF CRIMINAL PROCEDURE."
       (c)  A person commits an offense if the person is required to
make a disclosure under Subsection (b) and fails to make the
disclosure.
       (d)  An offense under this section is a Class A misdemeanor.
       SECTION 2.  This Act takes effect September 1, 2007.
