A BILL TO BE ENTITLED
AN ACT
relating to the authority of the boards of trustees of certain
school districts to close low-performing high school campuses.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter D, Chapter 11, Education Code, is
amended by adding Section 11.171 to read as follows:
       Sec. 11.171.  AGENCY APPROVAL REQUIRED FOR CERTAIN CAMPUS
CLOSURES. The board of trustees of a school district may not order
the closure of a district high school campus without first
obtaining the agency's approval of the closure. This section
applies only if:
             (1)  the district has an enrollment of at least 200,000
students; and
             (2)  the campus that the board proposes to close is
considered academically unacceptable under Section 39.132.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
