A BILL TO BE ENTITLED
AN ACT
relating to the dismissal of a charge for failure to carry and
exhibit a driver's license.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 521.025, Transportation Code, is amended
by adding Subsections (f) and (g) to read as follows:
       (f)  A judge may dismiss a charge under this section if the
defendant provides to the court within 10 working days a driver's
license:
             (1)  issued to the defendant;
             (2)  appropriate for the type of vehicle operated; and
             (3)  valid at the time of the arrest for the offense.
       (g)  The judge may assess the defendant an administrative fee
not to exceed $10 at the time the judge dismisses a charge under
Subsection (f).
       SECTION 2.  (a) The change in law made by this Act applies
only to an offense committed on or after the effective date of this
Act. For the purposes of this section, an offense is committed
before the effective date of this Act if any element of the offense
occurs before that date.
       (b)  An offense committed before the effective date of this
Act is covered by the law in effect when the offense was committed,
and the former law is continued in effect for that purpose.
       SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
