A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the dismissal of a charge for failure to carry and |
|
exhibit a driver's license. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 521.025, Transportation Code, is amended |
|
by adding Subsections (f) and (g) to read as follows: |
|
(f) A judge may dismiss a charge under this section if the |
|
defendant provides to the court within 10 working days a driver's |
|
license: |
|
(1) issued to the defendant; |
|
(2) appropriate for the type of vehicle operated; and |
|
(3) valid at the time of the arrest for the offense. |
|
(g) The judge may assess the defendant an administrative fee |
|
not to exceed $10 at the time the judge dismisses a charge under |
|
Subsection (f). |
|
SECTION 2. (a) The change in law made by this Act applies |
|
only to an offense committed on or after the effective date of this |
|
Act. For the purposes of |
|
this section, an offense is committed |
|
before the effective date of this Act if any element of the offense |
|
occurs before that date. |
|
(b) An offense committed before the effective date of this |
|
Act is covered by the law in effect when the offense was committed, |
|
and the former law is continued in effect for that purpose. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
