A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to authority to conduct a closed meeting to discuss |
|
|
certain personnel matters involving a municipal advisory body. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 551.0745, Government Code, is amended to |
|
|
read as follows: |
|
|
Sec. 551.0745. PERSONNEL MATTERS AFFECTING COUNTY OR |
|
|
MUNICIPAL ADVISORY BODY; CLOSED MEETING. (a) This chapter does not |
|
|
require the commissioners court of a county or the governing body of |
|
|
a municipality to conduct an open meeting: |
|
|
(1) to deliberate the appointment, employment, |
|
|
evaluation, reassignment, duties, discipline, or dismissal of a |
|
|
member of an advisory body; or |
|
|
(2) to hear a complaint or charge against a member of |
|
|
an advisory body. |
|
|
(b) Subsection (a) does not apply if the individual who is |
|
|
the subject of the deliberation or hearing requests a public |
|
|
hearing. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
