A BILL TO BE ENTITLED

AN ACT

relating to the purchase of certain used motor vehicles. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. The heading for Chapter 2305, Occupations Code, |
|
is amended to read as follows: |
|
CHAPTER 2305. [RECORDS OF] CERTAIN VEHICLE REPAIRS, SALES, AND |
|
PURCHASES |
|
SECTION 2. Subchapter A, Chapter 2305, Occupations Code, is |
|
amended by adding Section 2305.008 to read as follows: |
|
Sec. 2305.008. DISCLOSURE OF VEHICLE CONDITION; RIGHT TO |
|
INDEPENDENT INSPECTION. (a) A person engaged in the business of |
|
selling used motor vehicles shall provide a potential purchaser of |
|
a used motor vehicle a complete and detailed statement of the |
|
vehicle's condition. The statement must include a list of any known |
|
problems or defects affecting the vehicle's mechanical system, |
|
tires, brakes, and any other defect that substantially affects the |
|
vehicle's use, value, or safety. |
|
(b) A person engaged in the business of selling used motor |
|
vehicles shall permit a potential purchaser of a used motor vehicle |
|
to arrange for the reasonable inspection of the vehicle, including |
|
an inspection to be conducted away from the premises where the |
|
vehicle is offered for sale. This subsection does not prohibit the |
|
seller of the vehicle from imposing reasonable conditions on the |
|
time, place, and manner of the inspection. |
|
SECTION 3. This Act takes effect September 1, 2007. |
